3D Realms Fires Back On Gearbox Lawsuit: They Still Own Duke Nukem

3D Realms and Gearbox are about set to put up their dukes. The company has finally responded to Gearbox’s lawsuit involving their upcoming Duke Nukem game.

It’s really quite simple. 3D Realms claims that the Duke Nukem IP was not a part of the Asset Purchase Agreement that the two companies entered to enable the release of Duke Nukem Forever. Therefore, if you believe 3D Realms’ claim, Gearbox’s lawsuit does not even have a leg to stand on.

We can expect them to be going back and forth on this in the next few months, in public, and likely, in court. In spite of everything, the Duke Nukem still seems to have enough name recall worth fighting over, and will continue to have notoriety in the years to come.
