Activision settles with EA in Modern Warfare case

Activision has reached a settlement with one of the parties in the complex Call of Duty: Modern Warfare 2 case, putting an end to the $400 million USD claim against fellow publisher Electronic Arts. EA was accused of disrupting developer Infinity Ward by attempting to lure Jason West and Vince Zampella away from the company.
“Activision and Electronic Arts have decided to put this matter behind them,” said Activision lawyer Beth Wilkinson, following a hearing in Los Angeles Superior Court on Tuesday. Details of the settlement have, of course, not been disclosed.
West and Zampella will continue with legal action against Activision, alleging that the publisher owes them millions in unpaid royalties from Call of Duty: Modern Warfare 2. The latest twist to this saga is news of Activision’s ‘Project Icebreaker’; attempts to hack into the personal phones of the former Infinity Ward employees.
That case will go to court on 29 May.
A third related party, the Infinity Ward Employee Group (IWEG), also allege that Activision withheld owed royalties. This group has recently been paid $42 million USD by the publisher. However, this payment does not appear to have been part of an official settlement.
“Although it is a meaningful payment, it is only a small portion of what we are seeking in litigation”, IWEG lawyer Bruce Isaacs has said.
